Terms of Service

These Terms govern your use of ChargeNest’s website, mobile apps, and related services (the “Services”). By creating an account or using the Services you agree to these Terms and our Privacy Policy.

1. The marketplace

ChargeNest is a peer-to-peer EV charging marketplace. Hosts list private chargers/outlets; drivers discover, reserve, and pay for real-world charging sessions. ChargeNest also sells ChargeNest Power Meter hardware. ChargeNest is a technology platform — not a bank, utility, or insurer — and does not own most listed chargers.

You must be at least 18 years old and able to form a binding contract under Canadian law. You must provide accurate account information.

6. User-generated content

Listings, photos, reviews, and comments are user-generated content (UGC). You grant ChargeNest a license to host and display UGC to operate the Services. You must not post illegal, harassing, hateful, sexual, fraudulent, or infringing content.

7. Acceptable use

You may not misuse the Services (fraud, scraping that harms the service, circumventing geofence/safety, reverse engineering in violation of law, or encouraging illegal activity).

8. Disclaimers

Charging equipment and premises are provided by hosts or third parties. To the fullest extent permitted by law, ChargeNest disclaims warranties regarding uninterrupted availability, charger suitability, or third-party conduct. Use chargers at your own risk and verify site safety.

9. Limitation of liability

To the fullest extent permitted by applicable law, ChargeNest’s total liability arising from the Services is limited to the greater of (a) amounts you paid to ChargeNest in the 12 months before the claim or (b) CAD $100. ChargeNest is not liable for indirect, incidental, or consequential damages.

10. Termination

We may suspend or terminate access for Terms violations, fraud risk, or legal requirements. You may stop using the Services and delete your account as described above.

We may update these Terms. Material changes may require re-acceptance in the app. Continued use after the effective date constitutes acceptance where permitted by law.

12. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules.
