Terms of Service

These Terms govern your use of ChargeNest’s website, mobile apps, and related services (the “Services”). By creating an account or using the Services you agree to these Terms and our Privacy Policy.
1. The marketplace
ChargeNest is a peer-to-peer EV charging marketplace. Hosts list private chargers/outlets; drivers discover, reserve, and pay for real-world charging sessions. ChargeNest also sells ChargeNest Power Meter hardware. ChargeNest is a technology platform — not a bank, utility, or insurer — and does not own most listed chargers.
2. Eligibility
You must be at least 18 years old and able to form a binding contract under Canadian law. You must provide accurate account information.
3. Accounts
- You are responsible for credentials and activity on your account.
- You may use Sign in with Apple or Google where offered.
- You may delete your account in the app by typing delete my account to confirm and re-authenticating (password or Sign in with Apple/Google). You must have no active charging session and no pending withdrawal. Any leftover wallet balance is forfeited and recorded for audit — it is not a bank payout. Purchased wallet top-ups are never withdrawable.
4. Hosts and drivers
- Hosts must list accurate location, access, pricing, and electrical details and comply with local electrical, parking, HOA, and safety rules.
- Drivers must follow site rules, park safely, and leave when the session ends.
- Energy billing may use power-meter telemetry (per kWh) or flat hourly/idle rates as configured on the listing.
- Flat hourly listings: each charging session has a minimum charge of one (1) hour at the listed hourly rate. If your session lasts less than one hour, you are still billed for one full hour. Sessions longer than one hour are billed for actual time used (plus any applicable idle/parking charges).
- Metered listings: energy is billed from power-meter telemetry at the listed rate per kWh (plus any applicable idle/parking charges). Hosts may set a plug-in charge (default CAD $2.00) that is added on every metered session on top of energy and idle, so a short plug-and-leave still includes that amount. The one-hour minimum does not apply to metered energy billing.
5. Payments
- Payments for charging sessions and hardware are for physical goods and services consumed outside the app, processed primarily via PayPal and an in-app wallet. Where available, Apple Pay and Google Pay may be offered through PayPal checkout.
- Wallet top-ups may be used to pay for marketplace charging sessions and ChargeNest hardware. Topped-up funds are not withdrawable to your bank account. ChargeNest is not a bank and does not provide banking services.
- Host earnings from completed charging sessions (and related host credits) may be spent on charging or withdrawn to a Canadian bank account you provide, subject to processing and verification.
- By using the wallet and requesting a withdrawal, you agree that only host earnings are eligible for bank withdrawal and that topped-up funds remain for charging and eligible hardware use.
- Checkout for wallet top-ups may open in a secure system browser (Safari View Controller / Chrome Custom Tabs) so PayPal can process the payment and return you to the app.
- Minimum wallet balance to start a session: before you can start charging, your spendable wallet balance must cover an estimated session hold sized for a full charge of your largest vehicle battery (0%→100%). For flat hourly listings, the estimate is battery kWh ÷ charger kW (at least one hour) × the hourly rate. For metered listings, the estimate is rate × full battery kWh plus any plug-in charge. An idle buffer may be included when an idle rate is set. After platform fees/tax as applicable, the hold is generally floored at CAD $10 and capped at CAD $250 (free/zero-rate listings may require $0). The hold is a start gate only — you are charged the actual settled invoice when the session ends.
- Reservations may require a separate wallet minimum based on hold duration and idle rates, as shown in the app before you confirm.
- ChargeNest may charge platform fees disclosed before checkout or in invoices.
- Prices are generally in CAD unless stated otherwise.
6. User-generated content
Listings, photos, reviews, and comments are user-generated content (UGC). You grant ChargeNest a license to host and display UGC to operate the Services. You must not post illegal, harassing, hateful, sexual, fraudulent, or infringing content.
- We provide in-app report and block tools and may filter, hide, or remove UGC.
- We may suspend accounts that abuse the platform.

7. Acceptable use
You may not misuse the Services (fraud, scraping that harms the service, circumventing geofence/safety, reverse engineering in violation of law, or encouraging illegal activity).
8. Disclaimers
Charging equipment and premises are provided by hosts or third parties. To the fullest extent permitted by law, ChargeNest disclaims warranties regarding uninterrupted availability, charger suitability, or third-party conduct. Use chargers at your own risk and verify site safety.
9. Limitation of liability
To the fullest extent permitted by applicable law, ChargeNest’s total liability arising from the Services is limited to the greater of (a) amounts you paid to ChargeNest in the 12 months before the claim or (b) CAD $100. ChargeNest is not liable for indirect, incidental, or consequential damages.
10. Termination
We may suspend or terminate access for Terms violations, fraud risk, or legal requirements. You may stop using the Services and delete your account as described above.
11. Changes
We may update these Terms. Material changes may require re-acceptance in the app. Continued use after the effective date constitutes acceptance where permitted by law.
12. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules.
